Terms of Service for Pane Shatter

By using the Pane Shatter app (“App”), you agree to these terms. If you don’t agree, don’t use the App.

The service

Pane Shatter is a physics sandbox on iPhone. You launch a ball, crack a glass pane, and may keep a still of the break. Optional launch modes include a rubber pull, shaking the device, and blowing toward the microphone. Optional split-ball play divides the ball after the first impact. Features may change over time.

Eligibility

You must be able to enter a binding contract in your country. If you are under 18, you need a parent or guardian’s permission. The App is not directed at children under 13.

Your responsibilities

  • Use the App only in lawful ways.
  • Do not reverse engineer, tamper with, or circumvent the daily free limit, purchases, or other technical limits except as allowed by law.
  • Use Blow and Shake only on a device you control, and grant microphone or motion permission only if you want those modes.
  • Keep your device and iOS reasonably up to date.

Free and Unlimited

Without a subscription, you get a limited number of launches per local calendar day. That count is stored on the device (including Keychain) so deleting the App on the same device does not reset the day. Unlimited launches and premium looks, launch modes, and split-ball settings are sold through Apple In-App Purchase as auto-renewable subscriptions (currently weekly and six-month). Apple’s terms apply to payment, renewal, cancellation, refunds, and family sharing where available. We don’t control Apple’s billing system. Restore purchases from Settings if you reinstall or change devices while using the same Apple ID.

Photos and sensors

Stills are created on your device. Saving to Photos requires your permission. Microphone audio for Blow is processed on device and is not stored by us. Motion for Shake stays on device. See the Privacy Policy.

No warranty

The App is provided “as is.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation. Physics, cracks, and saved stills are entertainment, not a simulation of real glass or a professional imaging tool.

Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business, arising from use of the App. Our total liability for any claim related to the App will not exceed the amount you paid us for the App in the twelve months before the claim (or zero if you used only the free tier through us).

Third parties

Apple provides the App Store, StoreKit, device APIs, Photos, and optional review prompts. Their terms and privacy policies apply to those services. Paid Apple subscriptions are also subject to Apple’s Licensed Application End User License Agreement.

Intellectual property

The App’s design, code, and audiovisual presentation are owned by Dragos Roua. Stills you capture on your device are yours to keep and share, subject to these terms and applicable law. You do not get rights to our trademarks or source code.

Termination

You may stop using the App at any time by deleting it. We may stop offering the App or change features. Paid features already purchased remain subject to Apple’s rules.

Changes to these terms

We may update these terms. The “Last updated” date will change when we do. Continued use after changes means you accept the new terms.

Governing law

These terms are governed by the laws of Portugal, without regard to conflict-of-law rules, except where mandatory consumer law in your country says otherwise.
